Terms and conditions

1. General Provisions
1.1 These Terms and Conditions (hereinafter referred to as the "Terms") govern the sale and use of all paint products (hereinafter referred to as the "Products") provided by Akteon Paints (hereinafter referred to as the "Company").
1.2 By purchasing or using the Products, the client (hereinafter referred to as the "Client") acknowledges and agrees to be bound by these Terms.
1.3 The Company reserves the right to amend or update these Terms at its sole discretion without prior notice. The latest version of the Terms shall apply to all transactions.
 

 

2. Proper Use, Application, and Storage
2.1 The Company provides Technical Data Sheets (TDS) and Safety Data Sheets (SDS) with comprehensive information on the appropriate application, storage, and handling of the Products.
2.2 The Client assumes full responsibility for reviewing and strictly adhering to the instructions provided in the TDS and SDS.
2.3 The Company shall bear no liability for any loss, damage, or injury resulting from:

  • Improper or negligent application of the Product.

  • Failure to comply with the recommended storage and handling conditions.

  • Use of the Product in a manner inconsistent with its intended and specified purpose.

  • Combining the Product with incompatible substances or materials.

 

3. Limitation of Liability
3.1 To the maximum extent permitted by applicable law, the Company shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages resulting from the use or misuse of the Products.

  • Any personal injury, health risks, or environmental damage caused by failure to adhere to the safety guidelines specified in the SDS.

  • Any defects, malfunctions, or failures caused by improper surface preparation, environmental conditions, or unauthorized modifications.

  • Any damages beyond the total purchase price of the specific Product in question. 

3.2 The Client acknowledges that the Company does not provide any express or implied warranties beyond those explicitly stated in the Product documentation.

3.3 From the moment the Products are delivered to the shipping agency or to a third-party carrier chosen by the Customer, the risk of loss, damage, or delay in transport rests solely with the Customer. The Company bears no responsibility for any incidents that occur during transportation after delivery to the agency.

 

4. Compliance with Safety Regulations
4.1 The Client must consult and comply with the SDS before handling or applying the Product. The SDS provides essential safety and hazard information, including:

  • Appropriate protective measures for handling and use.

  • Emergency first-aid measures in case of accidental exposure.

  • Fire and explosion hazards, if applicable.

  • Proper disposal methods in accordance with regulatory requirements.

4.2 The Client is solely responsible for ensuring compliance with all relevant safety regulations and environmental laws when using, transporting, and disposing of the Product.

4.3 For emergency health concerns, Clients should immediately contact the Greek Poison Center at +30 21 0779 3777.

 

5. Technical Assistance and Warranty Limitations
5.1 The Company may provide technical assistance upon request; however, such assistance is advisory in nature and does not constitute a guarantee of Product performance or suitability for specific conditions.

5.2 The Company’s liability under warranty is strictly limited to the replacement of defective Products or a refund of the purchase price, at the Company’s sole discretion.

 

6. Governing Law and Jurisdiction
6.1 These Terms shall be governed by and construed in accordance with the laws of Greece.

6.2 Any disputes arising out of or in connection with these Terms shall be exclusively settled in the competent courts of Greece.
